Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and PaceHaven ("PaceHaven," "we," "us," or "our") governing your use of the PaceHaven mobile app and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Health & safety notice: PaceHaven provides general fitness information and is not a substitute for professional medical advice. Consult a physician before beginning any exercise program. See Section 4.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that you have the capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.

3. License to Use the Service

Subject to these Terms, we grant you a limited, revocable license to use the Service for your own personal use. You may not transfer or sublicense it, and you may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service, except where the law does not allow such a restriction.

4. Health Disclaimer & Assumption of Risk

The Service provides general fitness and training information for informational purposes only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any condition. We make no claims regarding medical or fitness results.

You should consult a physician before starting any exercise program, particularly if you are pregnant, elderly, unaccustomed to physical exertion, or have any medical condition, injury, or limitation. By using the Service, you represent that you are in good health and physically able to participate in exercise, and you acknowledge that physical activity carries inherent risks. You voluntarily assume all risks associated with your use of the Service, and you agree to stop exercising and seek medical attention if you experience pain, dizziness, or discomfort.

5. Subscriptions & Purchases

Some features may require a paid subscription or a purchase made within the app. Purchases are processed by Apple through your App Store account and are subject to Apple's terms. Paid subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID settings. Except where the law or Apple's policies require otherwise, payments are not refundable.

6. Acceptable Use

You agree not to:

Use the Service in violation of any law or these Terms;
Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems;
Upload malicious code or use the Service to harm others;
Misrepresent your identity or use another person's account without permission.

7. Your Content & Data

You retain ownership of the information and content you provide. You grant us a license to use, store, and process that information as necessary to operate and improve the Service, as described in our Privacy Policy.

8. Intellectual Property

The Service, including its software, design, text, graphics, and logos, is owned by PaceHaven or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or branding.

9. Third Party Services

The Service integrates third party services (such as Apple and Google). Your use of those services is governed by their respective terms and privacy policies, and we are not responsible for them.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACEHAVEN AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless PaceHaven and its affiliates from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which PaceHaven operates, without regard to its conflict of laws rules. Any disputes arising from these Terms or your use of the Service will be resolved in the courts located in that jurisdiction, unless applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
